It is against the law to smoke in a private enclosed vehicle if one or more of the occupants is under 18 years old. This constitutes an offence:
- It is prohibited for a person of any age to smoke in a private vehicle that is transporting someone under 18.
- It is an offence for a driver (including a provisional driver) to fail to prevent someone from smoking if one of the occupants is under 18.
These regulations do not extend to e-cigarettes.
